STATEMENT OF RENTAL POLICY


We are an equal opportunity housing provider. We fully comply with the Federal Fair Housing Act. We do not discriminate against any person because of race, color, religion, sex, handicap, familial status, or national origin. We also comply with all state and local fair housing laws.

Apartment availability policy. Apartments become available when they are ready to rent. A vacant apartment will not be deemed available until it has been cleaned, repainted, and prepared for a new tenant. We update our list of available apartments as each apartment becomes available. An apartment that was unavailable in the morning may become available later that day.

Occupancy guidelines. To prevent overcrowding and undue stress on plumbing and other building systems, we restrict the number of people who may reside in an apartment. In determining these restrictions, we adhere to all applicable fair housing laws. We allow two adults and one child under six years of age in a 1-bedroom apartment. We allow four occupants in a 2-bedroom apartment and five occupants are permitted in a 3-bedroom apartment.

We evaluate every apartment applicant in the following manner. You must submit a tenant application and answer all questions on the form. You must pay the non-refundable application fee ($60 for 1-person $70- for 2, and $80 for 3). We will determine whether from your responses to the application questions, you qualify for the apartment you are applying for. If you do not, we will reject your application. If you do, we will send your application to our screening company, which will check your credit report, criminal history, banking references, and employment and rental references to confirm that they meet our criteria. If you meet our criteria, we will approve your application. This process takes up to three days. We will rent available apartments to applicants in the order that their applications are approved.

Rental Criteria. To qualify for an apartment, you must meet the following criteria. Your monthly rent cannot exceed 33% of your monthly income. Your total monthly household expenses (which includes all revolving credit payments, installment credit, rent and utilities) do not exceed 70% of your monthly household income. You must be able to prove at least 1 year of employment immediately preceding the date of your application.

You must have satisfactory rental references from at least two prior landlords. If you have ever been evicted or sued for any lease violation, we will reject your application.

Credit History. Your credit record must be satisfactory. If your credit history shows any unpaid debts, we will reject your application.

Criminal History. If you have ever been convicted of a felony, we will reject your application. If you have been convicted of a misdemeanor involving dishonesty or violence within the past 10 years, we will reject your application.

Guarantors. If you do not meet one or more of the above criteria, you may be able to qualify for an apartment if you can get a third party to guarantee your lease. The guarantor must pass the same application and screening process that you must pass, except that we will deduct the guarantor’s own housing costs before applying his or her income to our income standard.

Dear Prospective Tenant:

We are working with neighbors and other landlords in this area to enhance the quality of this neighborhood. We want to assure that people do not use the property for illegal activity, nor do we want people that are not financially qualified to reside in our property. To that end, we have a thorough screening process. Besides investigating an applicant’s credit, we also research court records, verify income, interview employers, and order criminal background checks. Because it costs us money and time to do a thorough check of your application, there is a non-refundable processing fee of $60 for 1-adult and $70 for two adults. We will accept the first qualified applicant. If we do not process your application due to accepting an earlier applicant, your fee will be refunded. If you meet the application criteria and are accepted, you will have peace of mind knowing that other tenants in this apartment complex are being screened with equal care and that the risk of illegal activity occurring in the apartment complex is reduced. Application Screening Criteria

1. A complete application. One for each person not related by blood or marriage. If a line is not filled in (or the omission explanation is not satisfactory) we will return it to you.

2. Rental History verifiable from unbiased sources. If you are related by blood or marriage to one of the previous landlords listed, or your rental history does not include at least two previous landlords, we will require a qualified co-signer on your lease (qualified co-signers must meet all applicant screening criteria).

It is your responsibility to provide us with information necessary to allow us to contact your past landlords. We reserve the right to deny your application if, after making a good faith effort, we are unable to verify your rental history. If you owned rather than rented your previous home, you will need to furnish mortgage company references and proof of title ownership or transfer.

3. Sufficient income/resources. If the combination of your monthly personal debt, utility cost, and rent payments exceed 70% of your monthly income before taxes, we will require a qualified co-signer on your rental agreement. If the combination exceeds 75% of your monthly income, your application will be denied. Income must be verified through pay stubs, employer letter, or tax records. All other income, including self-employment must be verifiable through tax records.

4. You will be denied rental if:

a. You misrepresent any information on the application. If misrepresentations are found after a rental agreement is signed, your rental agreement will be terminated.

b. In the last 10-years you have ever been convicted of the manufacturer, use, or distribution of a controlled substance.

c. In the last 10-years you have a conviction for any type of felony crime.

d. In the last 10-years you have a misdemeanor conviction for dishonesty or violence.

e. Your credit check reflects any accounts that are not current.

f. You have a bankruptcy that has been discharged and do not have established credit for a minimum, continuous period of 2-years after the discharge date. All accounts after the discharge date must be current.

g. You are in bankruptcy while applying for an apartment and all post-petition debts are not current.

h. You do not have established credit

i. In the past 10-years, provided that it has not been discharged by bankruptcy proceedings, you have any unpaid collections, an FED(court ordered eviction), non-payment to any landlord, or any judgment against you for financial delinquency.

j. Previous landlords report significant complaint levels of noncompliance activity including but not limited to:

1. Repeated disturbance of the neighbor’s peaceful enjoyment of the area.

2. Reports of gambling, prostitution, drug dealing, drug usage, drug manufacturing.

3. Reports of any criminal activity or suspicious activity.

4. Damage to the property beyond normal wear and tear.

5. Keeping unauthorized pets on the property.

6. Reports of violence or threats to landlords or neighbors.

7. Allowing persons not on the lease to reside on the premises.

8. Failure to give proper notice when vacating the property.

9. Tarde rent payments or late to pay any other monies owed to landlord.

10. Previous landlords would be disinclined to rent to you again for any other reason pertaining to the behavior of yourself, your pets, or others allowed on the property during your tenancy.

11. You do not have either an active savings account and/or active checking account

12. If you are older than 18-years old, born in the United States and have had a social security number issued over the past 5-years.

13. Aliens without proper documentation (proper documentation includes but is not limited to passports, student visas, work visas, non-resident alien card)

There is an application fee ($60 for 1-person and $70 for 2). This is nonrefundable unless we do not process your application due to acceptance of an earlier applicant. We will process applications in the order they are received. Two pieces of identification must be shown. We require a current photo I.D. (driver’s license, state-issued identification card, military identification or passport) and either a social security card or non-resident alien card. These must be presented with the completed application. We will require up to 1 business day to process an application. We will accept the first qualified applicant.

APPLICANT'S DISCLOSURE TO LANDLORD

An Applicant may be aware of information about a circumstance that could perhaps make it difficult for the Applicant to occupy the property beyond a certain future date. Before reaching a decision on whether to enter into a lease, all of the parties need accurate information that enables Landlord and Applicant to tailor the length of the lease term to the Applicant’s individual circumstance. Landlord will rely on the information provided in this disclosure in reaching a decision on whether to enter into a lease with the Applicant and in reaching a decision as to the duration of any such lease. Military applicants, for example, may be aware of circumstances such as a possible upcoming deployment, a possible upcoming temporary duty assignment, a possible upcoming permanent change of station assignment, or some other circumstance that would make it difficult for the Applicant to occupy the property beyond a future date. This disclosure requires the military Applicant to communicate this information to Landlord. Civilian applicants may be aware of a potential job relocation or some other circumstance that may make it difficult for the Applicant to occupy the property beyond a future date. This disclosure requires the civilian Applicant to communicate this information to Landlord. The Landlord incurs a significant expense each time an apartment unit transfers from one tenant to another. This expense must be spread over the duration of the lease, which is one reason that longer leases have a lower rental rate.
